The Department of Education’s Use of Debarments and Suspensions to Prevent Title IV Violations

On December 18, 2018, NSLDN submitted a FOIA request to the United States Department of Education seeking all notices of debarment and all notices of suspension issued to an individual or entity participating in Title IV programs under the Higher Education Act. Debarments and suspensions are one effective way for the Department to prevent those who have already failed to follow Title IV requirements from further participation in the program.

A copy of the FOIA request is available here.

On January 9, 2019, the Department provided a Final Response stating that it had no documents in response to this FOIA. A copy of that letter is available here. On January 10, 2019, NSLDN filed an administrative appeal of that Final Response.
